Terms of Service

These Terms of Service ("Terms") govern your use of the TenantFort platform and services operated by TenantFort ("we," "our," or "us") at tenantfort.com. By accessing or using TenantFort, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. If you are using TenantFort on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms. You must be a landlord, property manager, or other party with a permissible purpose under the Fair Credit Reporting Act (FCRA) to use tenant screening features.

2. Account Registration

To use TenantFort, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at security@tenantfort.com if you suspect unauthorized access to your account.

3. Services

TenantFort provides a platform for:

  • AI-powered tenant screening, including document fraud analysis, scoring, and reporting.
  • Integration with third-party consumer reporting agencies for credit, criminal, and eviction history checks.
  • Automated employer and landlord verification workflows.
  • Fair Housing compliance tools, including audit trails and adverse action notice generation.
  • Property management features including lease management, rent collection, and maintenance tracking (available on Manage and Enterprise tiers).

We reserve the right to modify, suspend, or discontinue any part of the services at any time with reasonable notice.

4. Subscriptions and Billing

Plans and Pricing

TenantFort offers tiered subscription plans (Screen, Manage, Enterprise) with varying features and screening volumes. Current pricing is displayed on our pricing page. We reserve the right to change pricing with 30 days' advance notice.

Free Trial

New accounts receive 5 free screenings with no credit card required. Free trial screenings provide full access to Screen tier features. The trial does not expire.

Billing and Payment

Subscriptions are billed monthly or annually in advance. Payment is processed through Stripe. You authorize us to charge your payment method on file for recurring subscription fees and any overage charges. If payment fails, we may suspend access until payment is received.

Overages

If you exceed your plan's included screening volume, additional screenings are billed at your tier's per-screening overage rate. Overage charges are billed at the end of each billing cycle.

Cancellation

You may cancel your subscription at any time through the billing settings in your dashboard. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods. You retain access to your data for 30 days after cancellation, after which it may be deleted.

5. Your Responsibilities

By using TenantFort, you agree to:

  • FCRA compliance: Obtain proper written authorization from applicants before requesting consumer reports. Use consumer report information only for permissible purposes under the FCRA. Provide required pre-adverse and adverse action notices when denying applicants based on consumer report information.
  • Fair Housing compliance: Apply screening criteria consistently and without regard to race, color, national origin, religion, sex, familial status, disability, or other protected classes under federal, state, and local fair housing laws.
  • Data protection: Safeguard any applicant data you access through TenantFort. Do not share consumer report information with unauthorized parties. Dispose of consumer report data securely when no longer needed.
  • Accurate information: Provide accurate property, criteria, and account information. Do not misrepresent your identity or permissible purpose.
  • Lawful use: Use TenantFort only for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations.

6. Prohibited Uses

You may not:

  • Use TenantFort for any purpose other than legitimate tenant screening and property management.
  • Access consumer reports without a permissible purpose under the FCRA.
  • Discriminate against applicants based on protected class characteristics.
  • Attempt to reverse-engineer, decompile, or extract source code from the platform.
  • Use automated scripts, bots, or crawlers to access the platform without authorization.
  • Interfere with the platform's operation or other users' access.
  • Share your account credentials with unauthorized users.
  • Resell or redistribute TenantFort services without our written consent.
  • Upload malicious files, viruses, or harmful content.

7. AI-Powered Features

TenantFort uses artificial intelligence for document analysis, fraud detection, and scoring. While our AI is designed to be accurate and consistent, you acknowledge that:

  • AI analysis is a tool to assist your decision-making, not a replacement for it. You are responsible for final screening decisions.
  • AI fraud detection flags are indicators, not conclusive proof of fraud. Flagged items should be investigated further before acting on them.
  • Scoring results reflect the criteria you configure. You are responsible for ensuring your criteria comply with applicable laws.
  • AI technology has inherent limitations and may occasionally produce incorrect results. We continuously improve our models but do not guarantee error-free analysis.

8. Intellectual Property

TenantFort and its original content, features, and functionality are owned by TenantFort and protected by copyright, trademark, and other intellectual property laws. You retain ownership of any data you upload to the platform. By uploading content, you grant us a limited license to process, store, and display that content as necessary to provide our services.

9. Third-Party Services

TenantFort integrates with third-party services including consumer reporting agencies, payment processors, and cloud infrastructure providers. Your use of these services through TenantFort is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or practices of third-party services.

10. Limitation of Liability

To the maximum extent permitted by law, TenantFort shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the platform. Our total liability for any claims arising under these Terms shall not exceed the amount you paid to TenantFort in the 12 months preceding the claim. This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise).

11. Disclaimer of Warranties

TenantFort is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or completely secure. We do not provide legal advice — you should consult with a qualified attorney regarding your compliance obligations.

12. Indemnification

You agree to indemnify, defend, and hold harmless TenantFort, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any applicable law, including the FCRA and Fair Housing Act; or (d) your screening decisions and actions taken based on information obtained through TenantFort.

13. Dispute Resolution

Any disputes arising from these Terms or your use of TenantFort shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property infringement or other urgent matters.

14. Termination

We may suspend or terminate your access to TenantFort at any time for violation of these Terms, non-payment, or any conduct we reasonably believe is harmful to other users, us, or third parties. Upon termination, your right to use the platform ceases immediately. Sections related to intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the platform at least 30 days before taking effect. Your continued use of TenantFort after the effective date of changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which TenantFort is incorporated, without regard to conflict of law principles.
